Pursuant to the Federal Data Protection Act (FADP), we provide you with the necessary information regarding the processing of personal data collected during your experience on our website www.skillgym.com. 

 

1. CATEGORIES OF PERSONAL DATA SUBJECT TO PROCESSING | DEFINITIONS

 

Personal data provided or acquired in the course of your online browsing will be processed in accordance with the Federal Data Protection Act (hereinafter FADP).
Personal data: all information relating to an identified or identifiable person (e.g. name, surname, email addresses, IP address and navigation data in general).
Data subjects: natural persons whose data are processed (hereinafter also referred to as ‘You’).
Processing: any operation relating to personal data, regardless of the means and procedures adopted, and in particular the collection, storage, use, review, communication, archiving or destruction of data.
Communication: i.e. making personal data accessible, for example by allowing access, transmission or publication.

 

2. IDENTITY AND CONTACTS OF THE DATA CONTROLLER and DATA PROTECTION CONSULTANT

 

The entity that determines the purposes and means of the processing is Lifelike SA, a company incorporated under Swiss law with registered office at Corso San Gottardo, 16 – 6830 Chiasso (Switzerland) – CHE-178.566.624, (hereinafter also referred to as “Data Controller” or “Company” or “us”).

c) By accessing the “Talk to an Expert” section, we collect your personal information such as, for example, first name, last name, role in the company, contact information, password, in order to schedule the meeting you requested and provide you with the necessary information. Pre-contractual: provide the requested information service Data will be processed for as long as necessary to provide the requested feedback.
d) Creation of a test account: we will collect personal information, such as, for example, first name, last name, e-mail, role in the company and password in order to allow you to register and create YOUR test account, so that you can test the services offered by Skillgym. Pre-contractual For the duration of the testing phase
e) Management of Support Requests: we will collect your personal data (e.g.: e-mail), in order to provide you with any assistance required for the proper use of Your test account. You will be able to make the report by opening a “Ticket” which will be taken over and managed by the Data Controller. Contract Throughout the duration of the contract and use of the account
f) Direct Marketing: we will collect your personal information for sending newsletters upon consent. Consent Data will be processed until consent withdrawal

 

3.1 DATA PROCESSING METHODS

 

The processing will be carried out in automated and/or manual form, with methods and tools designed to ensure maximum security and confidentiality, by individuals specially trained to do so. The personal data collected will be kept in a form that allows the identification of data subjects for a period of time not exceeding the achievement of the purposes for which the personal data are processed.

 

4. RECIPIENTS OF PERSONAL DATA

 

Personal data may be processed by personnel acting under the authority of the Data Controller (duly instructed for this purpose), as well as third parties bound by confidentiality obligations, for the purpose of fulfilling their respective contractual obligations to the Data Controller. These third parties will process the data provided as Data Processors (Art. 9 DPA) or independent Data Controllers. Examples include: parties who provide services for the maintenance of the computer system and telecommunications networks used by the Data Controller; – consulting and support firms or companies; – authorities responsible for compliance with legal obligations and/or the provisions of public bodies, upon request.

 

5. TRANSFER OF PERSONAL DATA OUTSIDE THE CONFEDERATION

 

The website is based in Europe (hosting) and, therefore, personal data processed will be transferred outside the Swiss Confederation. It is specified that, in accordance with the DPA and the Federal Data Protection and Transparency Commissioner, the countries of the European Economic Area are third countries with adequate safeguards for the transfer of personal data.

6. RIGHTS OF THE DATA SUBJECT

 

Under the DPA, you are granted the following rights (non-exhaustive list):
● to obtain rectification of inaccurate or outdated personal data;
● withdraw the consent;
● to be informed in writing and free of charge whether personal data concerning you are being processed;
● prevent the disclosure of any sensitive personal data to third parties;
● obtain portability of personal data or request that they be transferred to third parties;
● request restriction or blocking of data processing, prevention of disclosure of data to third parties, or rectification or destruction of personal data;
● request the prohibition of specific processing of personal data and specific disclosure of personal data to third parties or the deletion or destruction of specific personal data;
● where neither the correctness nor inaccuracy of personal data can be proven, request that a note be added to indicate the dispute;
● request that the rectification, destruction, blocking, especially disclosure to third parties, in addition to the note on the challenge or ruling be communicated to third parties or published;
● have the processing of personal data declared unlawful.
Subject to any other administrative and judicial remedies, if you believe that the processing of your data violates the provisions of the DPA, you have the right to lodge a complaint with the competent supervisory authority, Federal Data Protection and Transparency Commissioner. It is understood that you may exercise your rights under the DPA (to the extent applicable) by contacting the Data Controller by writing to the above addresses.

 

7. ADDITIONAL INFORMATION | CHANGES | UPDATES

 

The Data Controller reserves the right to revise, update, add or remove any part of this privacy policy at its discretion at any time. If changes are made, the date of the update will be indicated.
